Yesterday, the All India Muslim Personal Law Board (AIMPLB) told the SC that ‘Triple Talaq’ is fundamentally undesirable. The board also urged the members of the Muslim community to start a social boycott of those who have used the word ‘Triple Talaq’ in one go “so that such incidents may be minimized”.
The main features of the new guidelines issued by the All India Muslim Personal Law Board (AIMPLB) for married couples are “social boycott” of Muslims who resort to triple talaq and the appointment of an arbitrator to settle marital disputes. On Monday the AIMPLB told the Supreme Court that it has issued “guidelines for both the husband and wife at the time of dispute” which is must and has to be followed. The AIMPL board also told that they will first try to mutually resolve the issues, if there are differences between a husband and his wife, by keeping in mind the provisions of the Islamic law and try to find and resolve the mistakes of others.
On Thursday, the board’s affidavit was filed by advocate Mr. Ejaz Maqbool in response to a query from a 5 judge bench which is headed by J S Khehar whether the AIMPL board was ready to advise brides to exercise their right to seek exclusion of triple talaq.
Popular lyricist and screenwriter Mr. Javed Akhtar also has lent his support towards ending triple talaq. According to him, the instant divorce practice should be legally and socially banned and it should be declared as a “cognizable offense”. Today he tweeted “All India Muslim Personal Law Board cannot be trusted. They are only trying to get off the hook. ‘Triple Talaq’ should be legally banned and declared a social offense.”
Today his tweet comes after a day when the AIMPLB told the SC that it will tell the community to “advise” the bridegroom and bride during the marriage to do away with the provision of the ‘triple talaq’ as it is undesirable in Shariat.
The AIMPLB board said, “If there is any favorable situation arises during the waiting period, the husband will retain his wife and then they should live as spouses. If the husband does not retain her during that period, then the ‘nikah’ will be automatically invalidated after the lapse of the waiting period and both husband-wife will be free and authorized to start his/ her new life”.
The board also clarified that if the wife is pregnant during that waiting period, the period will extend up to delivery and the husband will have to bear the expenses incurred during that period and he has to pay it immediately, in case the dowry has not been paid. The AIMPL board has also added another way for nullifying the marriage in which the husband will pronounce one talaq during the period of the purity of his wife, followed by another talaq in the 2nd month and the third talaq in the 3rd month.
