Today 6th March on Monday The Supreme Court hinted that it will take a final decision on the charges against Advani and others BJP leaders will be revived on March 22, 2017. The decision of the Allahabad High Court to acquit Advani, Murli Manohar Joshi, Uma Bharti and other BJP leaders has been challenged by the Central Bureau of Investigation (CBI) team. Babri Masjid, a 16th-century mosque, was demolished by a mob on December 6, 1992. The demolition of the mosque is one of the biggest incidents in India after Independence. It had triggered communal riots across the country that had killed hundreds of people. BJP leader L K Advani and Murli Manohar Joshi were present at the site when the masjid was pulled down.

The Rasthriya Sayamsevak Sangha (RSS)-led organizations are trying to construct a Ram Mandir at that disputed site. Today the Supreme Court hinted that it may revive conspiracy charges against 13 BJP and other RSS leaders Babri Masjid demolition case in 1992. The hint came from a bench of justices P Ghosh and R S Nariman hearing a petition by the CBI challenging the Allahabad court dropping conspiracy charges against these leaders, including BJP’s LK Advani, Murli Manohar Joshi, Uma Bharti and Kalyan Singh. They also include some Vishwa Hindu Parishad (VHP) leaders. The court said “We will not accept the discharge of Lal Krishna Advani and other leaders on technical grounds. We will allow CBI to file a charge sheet against 13 persons by including the conspiracy charges. We will ask the court to conduct a joint trial”.

The Hindu right-wing says Lord Ram was born at the spot where the mosque stood.

The appeals were filed by Haji Mahboob Ahmad and the CBI is against dropping of conspiracy charges against BJP leaders Advani, Joshi and 13 others for the demolition of the disputed structure on December 6, 1992, by the members of the Viswa Hindu Parishad (VHP). During the hearing, the bench also said that supplementary charge sheet was filed against 8 persons but not against the 13 who were discharged. Besides BJP leaders Advani, Joshi and Bharti, conspiracy charges were dropped against Kalyan Singh (present Governor of Rajasthan), Bal Thackeray and VHP leader A G Kishore also.

The Central Bureau of Investigation (CBI) team had accused them all, but a trial court discharged all of them in a decision upheld by the Allahabad High Court in 2010. And in 2015, the Supreme Court expressed concern over the delay in trial against those people involved in the demolition case and favored a joint trial. The SC’s intervention could revive those latent and inconclusive questions about the role of the senior Hindu leaders of the ruling party in the demolition case that triggered violence across India.

The Supreme Court also raised their concern and asked the CBI to explain why it unduly delayed the appeal against the Court order. Mr. Ahmad’s petition also claimed that the trial court bifurcated the actual demolition into separate cases.
